Terms of Service

By accessing Cossetlings.com, any associated webspaces, and/or purchasing, trading, or otherwise owning a Cossetling, you acknowledge that you have read, understood, and agreed to the terms listed below.

Failure to abide by these terms may result in a strike, a ban from Cossetlings.com and any associated webspaces, and/or account termination on the Cossetling website, depending on the severity of the violation.

General

• You must be 21 years or older to join Cossetlings.com or any associated webspaces.
• Any user found to be lying about being eighteen years or older will be banned without prior notice.
• Cossetlings are a closed adoptable species. You cannot make an official one without a MYO (make-your-own) item.
• Cossetlings.com does not own nor copyright the concept of flower tails or human/humanoids with satyr-inspired legs.
• The Cossetling website is based off the Open Source ARPG Lorekeeper framework. Cossetlings does not own and did not create Lorekeeper and its extensions.
• Cossetlings.com reserves the right to update these terms at any time without notice.

Site Content

Cossetlings.com is offered and made available only to those who are at least 21 years of age. By creating an account, using this service, or attempting to use this service, you verify that you are 21 years or older.

Cossetlings.com and its associated spaces may contain the following:

Fantasy violence
Infrequent use of strong language
Suggestive themes
References to alcohol and drug use
Simulated gambling with virtual currency
Mild blood

Cossetlings does not allow discussion of serious topics. This includes real world issues and anything sensitive or upsetting in nature. NSFW or otherwise adult content is not allowed on Cossetlings.com or any associated webspaces.

Staff does not monitor content displayed on individual user pages, and is not liable for user-submitted content that is unlawful or breaks our terms.  Any user-submitted content that is found to be unlawful or in conflict with our terms must be reported to the staff, and may be modified or result in disciplinary action towards the user responsible.

Staff has not reviewed all links present on site and is not liable for the content of third party websites linked on Cossetlings.com.

Any content displayed on this website can be modified, edited, deleted, reclassified, or added to at any time by Cossetling staff without notice. Content and services are provided "as is" and "when available" and our services are not guaranteed to be accessible to all users at all times.

User Conduct

Please be kind and respectful.
Users must not scam, harass, beg, steal from, or do any other harmful behavior to fellow users and Cossetlings staff.
It is the user’s responsibility to use a secure email and password.
Users should not post sensitive or private information regarding themselves or other individuals.
Cossetlings.com and associated webspaces may not be used for any unlawful purposes. Posting, sharing, distribution, or promotion of any illegal content is forbidden.
Users are limited to one account and, if banned, cannot create another account. Account sharing, transferring, or selling is not allowed.
Accounts with usernames deemed offensive, vulgar, hateful, impersonation, or unlawful may be modified or terminated.
Users cannot abuse bugs or exploits found on the site and must instead report them to the admin.
Use of third-party software to exploit/disrupt the site or gain advantage over other users is not allowed.
Discussions of account termination, strikes, or ban are not permitted on Cossetlings.com or any associated webspace.
Use of Non-Fungible Tokens (NFTs) or any cryptocurrencies is not allowed.

User Content

All work submitted to Cossetlings.com must be Cossetling-related. Work featuring other characters and/or other closed species cannot be submitted on-site or for rewards. Submissions must be either your own work or properly-credited commissions/gift art. AI work of any kind is not allowed.

Work made using premade bases is allowed if the base was specifically created for Cossetlings. On-base work cannot be submitted for rewards.

Submitting work gives Cossetlings the right to host, modify, and digitally redistribute it. Users retain ownership over submitted work and Cossetlings will not use it for profit.

If a user is banned or account closed, Cossetlings maintain the rights to display and use any submitted content during use of service.

When submitting content, users agree that they have permission to use that content, and that use or display of said content will not infringe upon the rights of a third party.  Users found submitting stolen or plagiarized content may be striked or banned.

Cossetlings is not liable for user-submitted content that is stolen or plagiarized from a third party.  If a user has stolen or plagiarized your content for use on Cossetlings.com, please contact admin@cossetlings.com.

User-created designs may not be based on characters from known “IPs” Intellectual Properties or designs owned by others.

Purchases

All sales of Cossetlings characters must take place on Cossetlings.com. You must have a Cossetlings account in order to receive Cossetling-related goods from a sale, trade, or gift. By having an account, you acknowledge sales are for intangible (digital) goods only.

Cossetlings characters, items, and currency may not be transferred to users under the age of 21.  All parties involve with transferring Cossetling goods to underage individuals will face disciplinary action.

Payments must be in USD through Paypal Invoice unless otherwise stated.

Do not send any payment until the invoice is sent.

Payments are required within 48 hours after a confirmed sale, claim, offer, or winning bid. Failure to do so will result in the design being put back up for sale.

Auction bids, once placed, may not be deleted, withdrawn, or edited to a lower amount. Doing so may result in a strike or ban.

Auctions end 24 hours after the first bid.

Chargebacks are not allowed for any reason. Users who chargeback will lose design ownership and be permanently banned.

Official/Guest Artists reserve the right to refuse service or sale for any reason.

Users agree to be fully responsible and liable for any fees, damages, claims, and losses that result from purchasing from or selling to other users in Cossetlings.com or related webspaces. Users also agree to not hold Cossetlings or its staff liable for any fraudulent trades or sales and that Cossetlings is not required to be involved in any disputes.

All transactions made on Cossetlings.com with real or virtual currency are final and non-refundable. Staff is not required to reimburse or compensate users in the event of an incorrect or false purchase. Please contact staff if there are any issues with shops or purchases.

Ownership

Owning a Cossetling gives you partial rights to that specific character design. You do not hold ownership over the Cossetlings species and therefore do not hold full rights over any Cossetling character design, even ones you designed.

Cossetlings will never revoke a design except for TOS violations. This includes a design being owned by someone under the age of 21 or issuing a chargeback to an official/guest artist. In these circumstances, Cossetlings will not be required to provide compensation.

Partial rights to an official Cossetling design means the ability to do the following:

• Transfer the character to another user, as long as you are in line with the character's current transfer limitations.
• Use the character on this website and for this website's services.
• Make edits to the character design by creating new artwork of the design within the design editing guidelines. All edits must be approved by staff before they are considered official. Accessorizing and changing outfits/hairstyles are able to be freely changed.
• Give the character a name and backstory, as long as it is in line with the Terms of Service and character creation guidelines. This includes the option to use the design for personal use and outside official lore.
• Display the original artwork and any artwork depicting the character on this website or in an offsite online gallery if credits to the artist(s) and designer(s) are included.
• Create new artwork or writing for the character as long as it is in line with the terms of service.
• Commission another artist to create artwork or writing for the character design.
• Create a Cossetling design that is an "alternate universe" version of a design you own, or create an "alternate" design based off a Cossetling you own. (Alternate as in "AU" meaning a different form of a character not related to Cossetlings.) Alternate designs are considered derivative parts of the original and cannot be transferred separately. In cases of designs you own but didn't create, permission from the original creator is required to make an alternate design.

By owning a Cossetling character you are agreeing that you will not do the following:

• Attempt to sell a character design for real life currency to anyone under the age of 21.
• Attempt to sell or transfer a character design to multiple different users at one time.
• Attempt to voucher (indirectly sell) a character design that you did not purchase yourself.
• Trade or exchange a character to another user if it is not able to be traded.
• Claiming any artwork or designs as your creation if they were not created by you, or otherwise miss-crediting a design or piece of artwork.
• Edit art that isn’t your own without the original artist’s permission.
• Create copies or reproductions of the design or its likeness to be transferred to other users.
• Mass producing any type of merchandise depicting the character design, reproductions of the character design, or artwork of the character design.
• Using a character design or deriative designs for commercial purposes. If you are unsure if use of a character is considered commercial, please message the admin onsite or admin@cossetlings.com.
• Use the character design in any way that could be harmful, offensive, obscene, defamatory, or unlawful.
• Only ownership rights are transferred when transferring a Cossetling character design to another user. Individual artist TOS still apply and should be followed and respected.

The original creator of any character design, artwork, or text has the right to display the content they have created depicting that character design, artwork, or text in their online gallery or portfolio even if they do not hold ownership over the character.

A user cannot revoke or void any Cossetlings character designs they have created, submitted, or previously owned if that design has been transferred to another user. Transfers are done at your own risk, and transfer reversals are done at the discretion of staff and we are not required to transfer a character design to you in the event of a fraudulent trade or transaction.

Official/Guest Artists retain partial rights to their designs, including all copyrights, rights to the intellectual property, and the rights to distribute, reproduce, and use in their online galleries. Official/Guest Artists cannot reuse or resell Cossetlings designs for personal and commercial projects unless they have regained ownership of the designs through trading, purchasing, gifting, or reclaiming due to terms violation(s).

Co-Owning a Cossetling is not allowed.

Voiding

Voiding is permanent and voided designs cannot be used on Cossetlings.com, even if ownership changes or another MYO slot is acquired. Cossetlings TOS no longer applies to voided designs, only the original artist(s) TOS.

Users may request to void a design as long as they currently own said design and with explicit permission from the original artist. Designs by official/guest artists cannot be voided.

Cossetlings owned by a banned user will be voided and no longer considered official. Banned users can not obtain official unvoided Cossetlings.

Copyright

Cossetlings holds copyright over the Cossetling species and all associated lore and content including species-specific design elements, non-playable characters (NPCs), templates, text, logos, and visual assets. Users creating any content involving the species or associated IPs are bound by our terms.

Cossetlings does not claim copyright over user-submitted content.

Submitting content to Cossetlings.com gives permission for it to be displayed or publicly linked to on this website or any associated webspaces.

Cossetlings is not required to remove, rework, or delete any content created by current or former staff and users that was submitted with the intent of being used for this website, any associated webspaces, or services.

Users are not permitted to distribute, modify, copy, exploit, use, or make derivative works from any content displayed on or created for Cossetlings.com unless explicit permission by Cossetlings is granted.

Disputes

You agree to indemnify, save, and hold harmless Cossetlings and its staff from any claims, losses, damages, liabilities, attorneys' fees and legal expenses, arising out of your use or misuse of Cossetlings, any content you post or submit, violation of these Terms, violation of the rights of another third party or entity, or any breach of the representations, warranties, and covenants made by you herein.  Cossetlings reserves the right, at your expense, to assume the exclusive defense and control of any matter for which you are required to indemnify Cossetlings and you agree to cooperate with Cossetlings' defense of these claims.

You acknowledge that Cossetlings has no control over, does not endorse, and has no duty to take any action regarding: which users gain access to Cossetlings or its services, what materials you access via Cossetlings, what effects such materials may have on you, how you interpret or use such materials, or what actions you take as a result of having been exposed to such materials. Cossetlings may contain links to websites containing content that some people may find inappropriate, harmful, or offensive. You release Cossetlings from all liability for you having acquired or accessed such materials through this website.

TO THE FULLEST EXTENT BY APPLICABLE LAW: Cossetlings and services provided through Cossetlings are provided “as-is” and “as available” without warranties of any kind either implied or expressed. Cossetlings does not represent or warrant that all content or material on Cossetlings are complete, error-free, reliable, accurate, or current. You understand and agree that you obtain, view, access, or download any material or data through the use of Cossetlings at your own risk and that you will be solely responsible for any loss or damages that results from the download of such material or data. You assume the entire cost of any necessary servicing, repair, or correction.

We reserve the right to discontinue any services on this website or close the website at any time, for any reason, without prior notice. If services are discontinued or the website is closed down permanently or temporarily, you agree to not hold us responsible or liable for any losses or damages that result from the closure. In the event of website closure or removal, you are still bound by these terms.
